The Loyola Law Review is proud to host its 2026 Symposium entitled, “The New Deal: Name Image and Likeness Compliance, Contracts, and the Legal Battle for College Athletics,” which will explore the rapidly evolving Name, Image, and Likeness (“NIL”) landscape and its profound implications for athletes, coaches, families, and educational institutions. Our Symposium brings together leading attorneys, legal scholars, compliance professionals, and athletic administrators to examine the rapidly evolving landscape of NIL in both high school and collegiate athletics.
The program will move from foundational principles and the representation of minor athletes to institutional compliance and regulatory uncertainty. The Symposium will then feature a keynote address from Verge Ausberry, Director of Athletics at Louisiana State University, offering an institutional leadership perspective on NIL and the future of college athletics. Following the keynote, the afternoon will turn to the practical realities of NIL deal-making, contract drafting, athlete protection, and conclude with a forward-looking discussion on litigation, legislation, and the long-term governance of college sports.

This panel addresses NIL transactions from the perspective of deal making and contract enforcement. This discussion will center on common NIL contract structures, valuation challenges, and the allocation of risk between athletes and commercial partners. Panelists will examine key contractual provisions, terms, termination, exclusivity, morality clauses, and dispute resolution, while highlighting pitfalls that may disadvantage athletes. The Panel will also consider the ethical and professional responsibilities of attorneys representing athletes in an increasingly commercialized collegiate sports market.

Panelist will discuss recent and pending cases nationally, sports agent clearing, salary cap guidelines. This discussion will conclude with an examination of proposed regulations, efforts to secure antitrust exemptions, and what these developments signal for the long-term governance of college athletics.
